However, it was Brazill, his grandfather, and perhaps the school that were liable, not Valor," a Florida appeals court found for Valor Corporation, distributor of a firearm legally sold and then stolen by then middle school student Nathaniel Brazill from his grandfather before he shot and killed his teacher, Barry Grunow, on the last day of school. Brazill had bragged to a friend about the firearm, which the jury found to be non-defective, and demonstrated that he knew how to operate it, and yet the lawsuit went forward against Valor, and was appealed after the distributor won in the lower court. “This is the kind of case that the Protection of Lawful Commerce in Arms Act would prevent,” said Lawrence G. Keane, senior vice president and general counsel of the National Shooting Sports Foundation. “It was a costly case that dragged on for years and placed an unnecessary burden on the defendant.”
