States Have Differing Takes On Emergency Powers

Confiscation of firearms by the New Orleans police following Hurricane Katrina has sparked in many state legislatures debates and the introduction of legislation addressing gun owners’ rights vs. emergency police authority. In separate items in the April 27 NRA-ILA electronic newsletter appear reports on: the Louisiana state house approving an amendment to prevent New Orleans-style gun confiscations during a natural disaster; the Arizona senate narrowly failing to override the governor’s veto of a bill that would have prohibited the imposition of firearms restrictions during a declared state of emergency; and an Oklahoma state representative wanting to change the current law in his state to allow gun confiscations during emergencies.
