New York City Lawsuit Update





A federal judge in New York City has called for a March 3 hearing on whether a federal appropriations act would require dismissal of the city’s lawsuit against firearms industry companies. The act bars the use of gun trace data in civil trials. Both the city and firearms industry defendants are opposed to the hearing, but Judge Jack B. Weinstein has refused to vacate it. In response, firearms industry lawyers have asked a federal appellate court to step in, arguing that Weinstein does not have jurisdiction because the case is on appeal. A decision is expected shortly. Weinstein ruled in December that the city’s case could go forward despite the passing of the Protection of Lawful Commerce in Arms Act, which protects firearms companies from frivolous lawsuits.
